AllThingsD: iPad mini event to be held in October separate from Sept. iPhone event
Following John Gruber and Jim Dalrymple’s articles pointing to two separate Apple events this fall (one for the iPhone and one for the upcoming iPad mini), AllThingsD has confirmed the case with its sources. The next-generation iPhone will likely be announced on September 12th and go on sale on September 21st, while the iPad mini is said to see its debut at some point in October. Apple and Samsung issue official statements on today’s rulings
Following Apple’s major win against Samsung in United States court regarding mobile device patents, both companies have issued statements. The first statement comes from Apple’s PR head , Katie Cotton, who is grateful for the jury’s time and effort. We are grateful to the jury for their service and for investing the time to listen to our story and we were thrilled to be able to finally tell it. The mountain of evidence presented during the trail showed that Samsung’s copying went far deeper than even we knew. The lawsuits between Apple and Samsung were about much more than patents or money. They were about values. At Apple, we value originality and innovation and pour our lives into making the best products on earth. We make these products to delight our customers, not for our competitors to flagrantly copy. We applaud the court for finding Samsung’s behavior willful and for sending a loud and clear message that stealing isn’t right. Cotton goes onto say that Apple values originality and innovation and that the company applauds the court for making it clear the “stealing isn’t right.” AllThingsD has the statement from Samsung’s PR team : Today’s verdict should not be viewed as a win for Apple, but as a loss for the American consumer,” Samsung said in a statement. “It will lead to fewer choices, less innovation, and potentially higher prices. It is unfortunate that patent law can be manipulated to give one company a monopoly over rectangles with rounded corners, or technology that is being improved every day by Samsung and other companies. Consumers have the right to choices, and they know what they are buying when they purchase Samsung products. This is not the final word in this case or in battles being waged in courts and tribunals around the world, some of which have already rejected many of Apple’s claims. Samsung will continue to innovate and offer choices for the consumer. Samsung calls Apple’s victory a loss for the American consumer. Google’s attempt to block U.S. imports of iPhone and iPad thwarted as ITC remands investigation of one patent
Following the verdict in the Apple vs Samsung trial today where Samsung was found guilty of infringing various Apple patents related to the case, Apple is also coming out a winner, at least temporarily, in Google/Motorola’s attempt to block imports of iPhones and iPads to the U.S. In late June we told you about Google’s attempt to block U.S. imports of iPhones and iPads based on a previous ruling that Apple infringed on one standard-essential Motorola patent. The initial ruling was under review by the ITC, which has power to block U.S. imports of Apple devices from Asia, with a decision expected at a hearing scheduled for today. The ITC has now concluded its review (via paid blogger FossPatents ), finding no violations for three of the four patents included in the initial suit (including the one mentioned above), but remanded an investigation on a fourth, non-standard essential patent to Judge Thomas Pender. The result? According to FossPatents , there might be a violation and import ban related to the patent, but a remand and ITC review could take up to a year: Apple was cleared with respect to three of Motorola’s patents-in-suit, including the aforementioned standard-essential one. But with respect to U.S. Patent No. 6,246,862 on a “sensor controlled user interface for portable communication device”, a non -standard-essential patent, the investigation was remanded to Administrative Law Judge Thomas B. Pender. The judge had found claim 1 of that patent indefinite and, as a result, not violated. The ITC has reversed his indefiniteness finding. As a result, there could (but need not) be a finding of a violation with respect to this patent, and an import ban… An initial determination made by a judge on remand is again subject to a Commission review. All in all, a remand can easily take a year The ITC was also expected to address its stance on whether the use of import bans in cases related to industry standard patents should be limited. FossPatents noted, “since the remaining patent-in-suit is not standard-essential, the ITC does not have to take a position in connection with this investigation on the issue of import bans over standard-essential patents.” Last week Google filed a new patent lawsuit against Apple with the ITC claiming Apple violated seven patents with various iOS devices and Macs. According to reports, the patents relate to features in Apple devices such as Siri, push email notifications, media playback on phones, and location-based reminders. Analyst interprets comments by Apple SVP Eddie Cue and doesn’t expect an Apple Television anytime soon
Update: Pacific Crest analyst Andy Hargreaves reached out to us with some clarification on his note to clients earlier today noting the “commentary in our note was our interpretation and our thoughts based on the meetings we had”: Nobody at Apple said anything to us about future products. The commentary in our note was our interpretation and our thoughts based on the meetings we had. It’s ok if you say “Analyst does not expect a TV any time soon”, but its incorrect to attribute the commentary to Apple management, particularly in the title. While recent reports claimed Apple is in deep negotiations with cable operators to create a new cable TV platform for Apple TV, many also tied the reports to the possibility of a full-fledged Apple HDTV. Jefferies analyst Peter Misek claimed just last week that Apple’s HDTV set is in full production , and he went as far as including 2 million units of the device at an average sale price of $1,250 in his model for early 2013. According to a note to clients from Pacific Crest analyst Andy Hargreaves, who spoke with Apple CFO Peter Oppenheimer and Senior Vice President for Internet Services Eddy Cue on Wednesday, Apple’s entrance into the HDTV world is “extremely unlikely in the near-term.” Fortune posted an excerpt from Hargreaves’ notes today following his meeting with Oppenheimer and Cue: An Apple Television Appears Extremely Unlikely in the Near-term Relative to the television market, Eddy Cue, Apple SVP of Internet Software and Services, reiterated the company’s mantra that it will enter markets where it feels it can create great customer experiences and address key problems. The key problems in the television market are the poor quality of the user interface and the forced bundling of pay TV content, in our view. While Apple could almost certainly create a better user interface, Mr. Cue’s commentary suggested that this would be an incomplete solution from Apple’s perspective unless it could deliver content in a way that is different from the current multichannel pay TV model. Unfortunately for Apple and for consumers, acquiring rights for traditional broadcast and cable network content outside of the current bundled model is virtually impossible because the content is owned by a relatively small group of companies that have little interest in alternative models for their most valuable content. The differences in regional broadcast content and the lack of scale internationally also create significant hurdles that do not seem possible to cross at this point. Several different reports earlier in the year pointed to the launch of a new TV-related service by holiday 2012. The New York Post reported in May that Apple would go ahead with a streaming service by Christmas despite issues with content providers, and recent reports suggested Apple could partner with AT&T and Verizon initially. Other analysts aside from Misek also pegged a late 2012-early 2013 launch for an Apple-branded HDTV set based on intel from component suppliers. Expect it next month! Apple issues take down notice for iPhone 5 mod kit, 48 hours left to get one
We brought you an “iPhone 5 conversion kit” earlier this week that essentially allowed you to purchase a back plate mod kit resembling the leaked images of the white and black next-generation iPhone backs . Apple does not want you to get your hands on the new iPhone design just yet, so it not surprisingly issued a take down notice to the makers of the mod kit. The sellers still promise to accept orders for the next 48 hours and continue to ship to those who have already ordered. The full letter sent to the sellers is below: We are authorized to send notice and takedowns on behalf of Apple Inc. (“Apple”), the owner of the federally registered Apple logo trademark (among others) hereinafter referred to as the Apple Trademark(s). We are writing to request your assistance with a website hosted by xxx INC that is violating Apple’s intellectual property rights. The website, http://iphone5mod.com/, is offering for sale and selling merchandise bearing counterfeit Apple trademark(s). Such illegal use of Apple Trademark(s) is a violation of federal and State trademark laws. S. Korean court rules that Samsung and Apple infringed on each other’s patents
Via @EvanRamstad from WSJ: A Seoul court ruled Friday that Apple had infringed on two of Samsung’s technology patents and “must stop selling the infringing products in South Korea”. In addition, the judge said Samsung infringed on Apple’s “bounceback” design patent, but not its icon design patent. From the sound of it, these only apply to older models of Apple’s products (perhaps pre-Qualcomm, now Apple is indemnified?) and the damages are in the tens of thousands of dollars which is meaningless. Pre-iPhone launch is getting crowded: Motorola/Google, Microsoft and now Amazon are all opening for Apple
. When word that Apple was planning an iPhone launch in September this year hit, the other big guys in the space all seemed to get scurrying. Microsoft’s Windows 8/Nokia event was planned for September 5th in New York City and announced on August 15th. Google subsidiary Motorola planned an event for that same Day in New York City (easy for the Tech Press!). Invites went out on August 17th. Droid RAZR HD is the likely main event. Today, Amazon announced that it would be having an event in LA in which it will likely reveal successors to the Kindle Fire which may include a 10-inch tablet and perhaps even a phone. Why are these guys all lining up Apple to be the main event for the holidays? Why not wait until after Apple’s event? Google moving Google I/O until after the WWDC event certainly seemed to help the Nexus 7? It doesn’t matter. These three major players will all get their few days of fame and then totally get washed out by the iPhone event on the 12th.
